Bastos believes that the reason for which Mr. Nouri has been arrested and imprisoned is basically wrong.
The Swedish court claims that Mr. Nouri has been arrested for being involved in assassination of MKO members and its connection with Mersad Military operation while his lawyers say that he has had no role in this military operation.
Speaking to IRNA, Bastos said that although Mr. Nouri has been active in Iranian prisons four decades ago, he has had no role in a military operation that began from the Iraqi soil into Iran and therefore we are opposed to charges of war crimes against him.
If he was not there and if he had no military participation, his case cannot be talked about as war crimes because there must be a connection between a crime committed by a combatant or any other person during a war or any other armed conflict with that war, the legal expert said.
It can be said that the order to execute some prisoners in Iran can even be the consequence of war and is not Mr. Nouri's personal responsibility, he added.
