Ayatollah Khamenei, the Supreme leader of the Islamic Revolution of Iran in 2017, in a meeting with the members of the government, criticizing the performance of the United Nations and emphasizing the need to pursue several important cases of human rights crimes by the United States of America, pointed to several specific cases of gross human rights violations by the United States like burning of the Dawoodi sect and the crimes of America in Guantanamo and Abu Ghraib prisons.
The Supreme Leader of the Islamic Revolution's demand regarding the follow-up of human rights violations by the United States is based on a strategic view and should be included in the agenda of relevant institutions such as the judiciary and the Ministry of Foreign Affairs. Also the agents of Iran public diplomacy should be included, especially radio and television and members of the media.
One of the clear examples of the violation of human rights by the US is the assassination of martyr General Qassem Soleimani and martyr Abu Mahdi al-Muhandis, which the fair and free jurists of the world have confirmed its ugliness and considered this crime illegal and contrary to legal standards.
America's crime in the assassination of Martyr Soleimani as an Iranian military force that was present in Iraq at the official invitation of that country is a legal issue and can be pursued by Iranian, Iraqi officials, and international judicial institutions for the following reasons and can issue a verdict against the American perpetrators and causes.
In 2008, after the end of the US occupation of Iraq, a security agreement was signed between the governments of Iraq and the US, according to which the US committed to recognizing the sovereignty of Iraq. According to one of the provisions of this agreement, the United States must carry out all its military actions in Iraq in coordination with the country's military forces; But the US, without coordination with the Iraqi military authorities, arbitrarily assassinated two Iranian and Iraqi military commanders in Baghdad. In this regard, the Iraqi authorities have officially denied that the US coordinated with them in the assassination of these two official commanders of Iran and Iraq.
In the summer of 2013, ISIS, with the support of America and several regional countries, attacked Iraq and Syria and took a large part of the territory of these countries as a result of their brutal crimes. The UN Security Council condemned this action but refrained from taking practical action to defend the oppressed people of Iraq and Syria. In this situation, Iraq and Syria asked for help from some countries, including Iran, and this official request was the reason for Iran's legitimate presence in the form of an advisory mission in these countries.
Iran's presence was a legitimate, legal and effective presence to eradicate terrorism since it was done at the invitation of Iraq and Syria. Basically, any country that causes stability in the region, its presence is legitimate for the people, and any country like America that causes instability in countries is considered illegitimate. The legitimate presence of Iran led to the defeat of terrorism, especially the Wahhabi group of ISIS, as well as the reduction of the illegitimate presence of hegemonic and interventionist countries, including the United States, in West Asia. Since the influence of the legitimate power caused the failure and isolation of the illegitimate power, the United States attempted to assassinate martyred generals.
Most of the world's jurists, even some American judges, believe that this assassination was carried out as an act against the national security of an independent country and should be dealt with in international courts. In other words, the criminal title of this act is a crime against the national security of a country, and the legal way of dealing with it is different from normal murders.
To justify its crime, the White House put forward reasons such as preventive action to stop Iran's attacks on the United States and preemptive action for defense, which were found to be legally illogical, and the United Nations declared this action to be extra-legal murder. Even in the US Congress, there were objections to this action due to the violation of the US Constitution, and some Congress representatives criticized this crime.
Commander Soleimani had entered Iraq as a guest of the Iraqi government to carry out a two-day mission, and his cowardly assassination was a gross violation of the Geneva Convention and also against Article 6 of the Civil Covenant and the inherent right to life, and according to Article A of the Statute of the International Criminal Court, murder is considered intentional.
This assassination is a violation of the UN Security Council Resolution 1368, and since the victims of the crime are Iranian and Iraqi nationals, the internal laws of Iran and Iraq can be invoked to punish the perpetrators and perpetrators.
So far, the documents of the assassination of Iranian and Iraqi commanders have been about 4,000 pages and 46 suspects have been identified, including former US President Donald Trump and former US Secretary of State Pompeo, who have admitted to participating in the assassination by ordering it are among the first defendants. For this reason, the Judiciary of the Islamic Republic of Iran has opened two legal and criminal cases in this regard, and the proceedings are ongoing.
The assassination of the martyred General Qassem Soleimani is a clear example of the violation of human rights by the United States and as a crime against humanity, and the expectation of the noble people of Iran is that the relevant authorities will follow the matter seriously by adopting expert measures, will find the perpetrators of this crime and subject to punishment.
